Job Title:               Compliance Registration and Licensing Supervisor-Pesticides

Nature of Work:
Under limited supervision, the Compliance, Registration and Licensing Supervisor coordinates the enforcement and compliance activities of the Regulatory and Environmental Affairs Division Pesticide Regulatory Programs to ensure compliance with state and federal laws and regulations related to pesticide product registration and renewal; pesticide certification, training, and recertification; pesticide use, storage, and disposal.

Examples of Work:

• Reviews case files, previous history of non-compliance, and applicable laws and regulations to determine if violations of the West Virginia Pesticide Control Act or Regulations Pursuant to the Act have occurred and develops enforcement actions when appropriate.
• Ensures that all enforcement actions comply with laws, regulations, civil penalty decision matrix, and other Department guidelines and policies; follows established priorities for case reviews; prepares all enforcement related correspondence and ensure appeal processes are held and conducted as required by the Assessment of Civil Penalties and Procedures for Consent Agreements or Negotiated Settlement.
• Maintains an enforcement database and performs a priority setting exercise to project the inspection emphasis on an annual basis.
• Identifies compliance related issues and makes recommendations to the Certification and Training Supervisor and Pesticide Regulatory Officer Supervisor.
• Prepare evidence and give testimony for informal and formal hearings.
• Perform administrative duties as Supervisor of the registration and licensing staff including approving timesheets and leave requests.
• Routinely interacts with West Virginia’s industries, federal/state officials and law enforcement organizations, special interest groups, and the public to communicate program services and regulatory requirements.
• Utilize available databases to maintain accurate and current databases of pesticide products, pesticide businesses, pesticide dealers, pesticide consultants, private applicators, commercial applicators, public applicators, registered technicians, and hypersensitivity.
• Processes all FIFRA Section 18 Emergency Exemption and Section 24c Special Local Needs registrations.
• Assist Registration and licensing in the review of product labels and licensing applications and determine acceptability when needed.
• Assist in the preparation of mid and end of year reports as required by Pesticide Cooperative Agreement with EPA Region 3.
• Evaluate and recommend actions concerning current pesticide related laws, regulations, and proposed legislation; and serve as a resource on pesticide related environmental issues to the citizens of West Virginia.
• Attend conferences with or without a supervisor in order to keep abreast of new technologies and/or assist with the implementation of new program procedures.
• Other duties as assigned.

Working Conditions:   Normal office environment; sitting, standing, walking, and operating a computer and other office equipment.

Knowledge, Skills, and Abilities:

• Advanced knowledge of the functions and objectives of the Department related to area of assignment.
• Seasoned knowledge of the laws and regulations pertaining to the program area.
• Expert ability to maintain detailed records according to a prescribed format.
• Excellent ability to deal with the public in an effective and courteous manner, and to establish and maintain effective working relationships with supervisors, associates, other organizations, and the general public.
• Advanced ability to analyze operational procedures and prepare reports of findings and recommendations for modifications.
• Proficient use of computers and software including Microsoft Office (Word, Excel, and Access).
• Knowledge of pesticide production, storage, use and disposal.
• Knowledge of the Federal Insecticide Fungicide and Rodenticide Act (FIFRA) and West Virginia Pesticide Control Act.

Minimum Qualifications:
Education:  Graduation from a four-year college with a Bachelors’ degree in the biological or chemical sciences, agriculture, or related field required.
Experience:  Four years of employment in a related field, which must have included complex or administrative duties.
Substitution: A Masters’ degree from an accredited four-year college or university may be substituted for the experience required.

Additional Requirements:

• Valid driver’s license is required.
• Satisfactory completion of pre-employment drug testing.
• Satisfactory completion of pre-employment law enforcement background investigation, including DMV records.
• Must maintain a positive image of the Commissioner, West Virginia Department of Agriculture, and the State of West Virginia.
